Terms & Conditions
Member Obligations:
1. Members shall provide a F45 Training West Waltham Informed Consent Form, as it may be updated.
2. Members are responsible for the prompt payment of the Monthly Membership Fee. F45 Training West Waltham provides for payment by credit card or electronic funds transfer. Credit Card or EFT transactions will be processed on the Member's Renewal Date (the day of the month in which they join). Failure by a member to timely pay the monthly membership fee shall be a default on the part of the member which will result in the suspension or cancellation of their membership. A member's default shall not relieve the member of the obligations under this agreement. Further terms and conditions concerning payment appear on the F45 Training West Waltham website.
3. Members shall observe all F45 Training West Waltham rules and policies as those rules and policies may be updated and posted on F45 Training West Waltham website. These rules and policies shall include: (1) that members will make safe use of the facility and equipment; (2) the member represents the member is in good health and has no disability, impairment, injury, disease, or ailment preventing him/ her form engaging in active or passive exercise or which would cause increased risk or injury or adverse health consequences as a result of use of F45 Training West Waltham's programs or facilities in any manner; (3) that member agrees to refrain from use of drugs, alcohol, etc. on the premises or to arrive at the premises while intoxicated; (4) members acknowledge that F45 Training West Waltham will not provide medical treatment for members but will maintain First Aid supplies and an AED on site.
4. Members acknowledge that F45 Training West Waltham's fees and programs may change from time to time. Members shall be notified of any change in fees or programs at least thirty (30) days prior to a change in fees.
5. Each F45 Training class is capped at a maximum level of participants. Access to the F45 Training classes is available through the F45 Training Challenge Application or through the F45 Training West Waltham website. When available spaces in F45 Training classes fill up, the reservation system will create a waitlist for that class. If you need to cancel a reservation, you may do so with at least eight (8) hours notice. If a member fails to provide timely notice of a cancellation to a class which has a waitlist, another member is not able to participate in that class. Accordingly, F45 Training West Waltham reserves the right to assess a $15 fee for any and all late cancellations. F45 Training West Waltham reserves the right to charge a $20 fee for any and all members who do not late cancel but instead not attend a scheduled session. Members acknowledge that any so assessed will be added to their monthly payment.
6. Members should not bring valuables onto club premise. F45 Training West Waltham shall not be liable for the loss or theft of, or damage to, the personal property of a member, including items left in lockers or elsewhere on its premises.
7. Memberships may not be transferred or assigned to any person other than the member that is party to this agreement.
8. All disputes arising out of this Agreement or your membership and participation in F45 Training West Waltham's programs shall be settled by arbitration pursuant to the Commercial Arbitration Rules of the American Arbitration Association, and judgment on the award rendered by the Arbitrator(s) shall be binding, conclusive and non-appealable and may be entered in any court having jurisdiction thereof. 9. Except for the rules, regulations and schedules posted at the premises or issued on the website by F45 Training West Waltham from time to time at its discretion, all of which are incorporated into this Agreement, this Agreement constitutes the entire and exclusive agreement between parties relating to the subject matter hereto and supersedes any oral or other written understanding. This Agreement only may be modified in writing executed by a duly authorized representative of F45 Training West Waltham. If any provision or portion of this Agreement tor the application thereof to any person or party circumstances shall be invalid or unenforceable under applicable law, such event shall not affect, impair, or render invalid or unenforceable the remainder of this Agreement.
10. F45 Training West Waltham reserves the right to revoke and cancel a membership at any time for any reason.
Please note that this fee is non-refundable and will not be prorated if you choose to cancel your membership before the end of the period.
Cancellation:
By signing below, I acknowledge Subject to the provisions below, a membership may be canceled by written notice to F45 Training West Waltham in person or by certified mail. The membership must be canceled 30 days before the expiration day (the "Renewal Date") prior to the member's upcoming billing date or the next agreed upon monthly commitment period. Failure to cancel 30 days before the expiration day (the “Renewal Date”), the Membership Agreement will automatically auto renew for the original agreement term. Cancellations shall be made by providing written notice to F45 Training West Waltham in person at 475 Winter Street, Unit 10, Waltham, MA 02451 or by certified mail. If the membership contract is broken prior to its original completion date, the member will be responsible for paying fifty percent of the remaining contract or $250, whichever is higher.
Cancellation Rights Members - have certain statutory rights to cancel their membership.
Consumer's Right to Cancellation:
You may cancel this contract without any penalty or further obligation by causing a written notice of your cancellation to be delivered in person or postmarked by certified or registered United States mail within three (3) business days of this contract or the date of your receipt to the address specified in this contract.
Additional Rights to Cancellation:
You or your estate may also cancel this contract for any of the following reasons: if upon a doctor's order, you cannot physically or medically receive the services because of significant physical or medical disability for a period in excess of three months; in case of your death; if the health club services to be provided under this contract are not available because the seller fails to open a planned health club or location, permanently discontinues operation of a health club or location, or substantially changes the operation of a health club or location; if you move either your residence of your place of employment more than twenty-five miles from any health club operated by the seller or a substantially similar health club which will accept the seller's obligation under the contract.
