FS8 CALGARY & TRUMAN HOMES 1995 INC: LIABILITY WAIVER & ASSUMPTION OF RISK
I, the participant named below, have agreed to participate in the FS8 workouts, exercise and training programs, classes, events, and any other services (fitness or otherwise) offered at FS8 studios in Calgary (the "Workouts").
The Released Parties
In this waiver, the "Released Parties" means, collectively, 2651504 Alberta Corporation, 2732639 Alberta Corporation, and 2763684 Alberta Inc., each operating under the FS8 brand in Calgary; FS8 PTY LTD and FS8 Incorporated; Truman Homes 1995 Inc and all of their related entities, affiliates, successors, assignees, franchisees, licensees, officers, directors, employees, contractors, and agents.
Nature of the Activities
I acknowledge that the Workouts are recreational fitness activities and may involve strenuous physical activity, including, but not limited to, yoga, Pilates (including reformer Pilates), muscle strength and endurance training, cardiovascular conditioning, and the use of specialized fitness equipment, including reformer machines.
Participant Eligibility
I confirm that I am at least 16 years of age and that if I am under 18, this waiver has also been signed by my parent or legal guardian.
Assumption of Risk
I understand and accept that participation in the Workouts involves inherent risks, including but not limited to: muscle strains, pulls, or tears; broken bones; joint injuries, including injuries to knees, back, shoulders, and feet; falls or equipment-related injuries; heat-related illness; cardiovascular events, including heart attack; aggravation of pre-existing conditions; and serious injury or death.
I affirm, and I re-affirm each time I participate in a Workout, that I am in suitable physical condition to participate, that I do not suffer from any known disability or condition that would prevent or limit my safe participation, and that I participate voluntarily and at my own risk.
Release & Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF ALBERTA, I HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, AND CAUSES OF ACTION ARISING FROM OR IN CONNECTION WITH MY PARTICIPATION IN THE WORKOUTS, INCLUDING CLAIMS RESULTING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. I FULLY UNDERSTAND THAT I MAY INJURE MYSELF AS A RESULT OF MY PARTICIPATION, AND I RELEASE THE RELEASED PARTIES FROM ANY LIABILITY NOW OR IN THE FUTURE FOR ANY CONDITION, INJURY, ILLNESS, OR DEATH THAT I MAY SUFFER DIRECTLY OR INDIRECTLY FROM PARTICIPATING IN THE WORKOUTS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
This waiver does not apply to claims arising from gross negligence, reckless conduct, or intentional acts.
Studio Rules & Medical Consent
I agree to follow all studio rules and staff instructions, to use equipment safely and only as directed, and to inform staff of any injury, pregnancy, or medical condition prior to participating. In the event of an emergency, I consent to receiving necessary medical treatment and accept responsibility for associated costs.
Acknowledgement
By signing below, I confirm that I have read and understood this waiver, that I understand I am giving up certain legal rights, including the right to sue the Released Parties for ordinary negligence, and that I sign voluntarily.
